According to the Delhi High Court, the Protection of Children from Sexual
Offenses (POCSO) Act was never intended to criminalize young people’s
consensual romantic relationships; instead, it was created to safeguard
minor children from sexual exploitation. When giving bail to an accused in
a POCSO cum rape case, Justice Jasmeet Singh stated, “In my opinion, the
aim of POCSO was to safeguard children below the age of 18 years from
sexual exploitation. It was never meant to criminalize consensual romantic
relationships between young people.”
